How do I know if I am getting the right amount of workers' compensation benefits?

This is never an easy question to answer as it depends on a variety of items. This typically includes the following:

  1. Date of Injury: The date of injury controls the law that gets applied. Year by year the law changes which could effect the amount and entitlement to benefits.
  2. Average Weekly Wage: See how to calculate the AWW.
  3.  Benefit Type: Is it temporary total “TTD”, temporary partial “TPD”,  permanent total “PTD” or permanent partial “PPD”?
  4.  Duration of Benefits: The days or weeks of benefits.

With these types of questions it is always important to consult with an attorney. Our office offers a free consultation and would be happy to discuss your entitlement to benefits.
